A dwelling is a building or part of a building which satisfies all the following conditions: it must be above ground, intended for human habitation, capable of being occupied and used as such regardless of whether occupation requires both or fewer than two occupants.

A dwelling may also be an inhabitable tent, hut, caravan or houseboat so long as it is in fact intended and capable being occupied and used as such without requiring any other additional form of accommodation. Finally, no size limit applies to dwellings but they should satisfy certain safety requirements set out by law.
